WoonView Terms and Conditions

WoonView is a digital platform that helps home seekers manage and compare properties, documents, viewings, notes and analyses in an organised way. WoonView supports users in their property search, but is not a substitute for a buying agent, a structural survey, a valuation, legal advice, financial advice or notarial advice.

1. Definitions

In these terms and conditions, the following definitions apply:

WoonView: the provider of the platform, the website, the app and associated services.

User: any person who uses WoonView, with or without an account.

Platform: the website, app, software, analyses, reports, comparison features and other digital services of WoonView.

Document analysis: the automated or semi-automated analysis of documents, data or other information entered or uploaded by the user.

Subscription: a paid form of access to certain features of WoonView.

2. Applicability

These terms and conditions apply to all use of WoonView and to all agreements between WoonView and the user.

By creating an account, taking out a subscription or using the platform, the user agrees to these terms and conditions.

Where additional terms apply to a specific service, these are clearly stated in advance. In the event of a conflict, the additional terms prevail.

3. WoonView’s services

WoonView provides digital support in searching for, assessing and comparing properties. The services may include:

  • adding and managing properties;
  • uploading and analysing documents;
  • producing summaries, points of attention and risk indications;
  • comparing properties;
  • recording notes and viewing information;
  • displaying neighbourhood, property or sustainability information;
  • making checklists, reports or other tools available.

The analyses and information provided by WoonView are intended as an aid to the user’s own assessment. The results are indicative and may be incomplete, outdated or incorrect.

WoonView gives no guarantee that a property is suitable for purchase, that all risks are found, or that an analysis is complete or free of errors.

4. No professional advice

WoonView does not provide legal, structural, financial, tax, mortgage, notarial or estate agency advice.

Information, flags, summaries and risk assessments provided through WoonView are intended as support and may not be regarded as professional advice or as a substitute for it.

The user remains responsible for taking decisions about a property, including making offers, signing agreements, having surveys carried out and engaging experts.

Where there is any doubt about legal, structural, financial or tax consequences, the user must always consult an appropriate expert.

5. Account and use

An account may be required for certain features. The user is responsible for entering data correctly and for keeping login details confidential.

The user may only use the platform for their own lawful purposes. It is not permitted to:

  • upload incorrect, misleading or unlawful information;
  • upload documents for which the user has no right of use;
  • process third-party personal data unnecessarily or unlawfully;
  • circumvent security measures;
  • copy, scrape, reverse-engineer or disrupt the platform;
  • use WoonView for fraudulent, harmful or illegal activities.

WoonView may temporarily block or terminate access to the platform in the event of misuse, security risks, payment arrears or breach of these terms and conditions.

6. Uploaded documents and entered data

The user is responsible for all documents, data, photos, notes and other information that they upload or enter.

The user declares that they are entitled to use this information and to make it available to WoonView for analysis within the platform.

WoonView may use uploaded or entered information to provide the service, including processing, summarising, analysing, structuring and displaying results to the user.

WoonView endeavours to process documents carefully, but cannot guarantee that all relevant provisions, risks, amounts, exceptions or particularities are correctly identified.

7. AI analysis and automated processing

WoonView may use artificial intelligence, algorithms, language models and automated systems to analyse documents and property information.

AI results may contain errors, misinterpret information or miss relevant context. The user must always verify important conclusions against the original documents or have them assessed by an expert.

In the event of a discrepancy between a WoonView analysis and the original document, the original document always prevails.

WoonView may improve, change or extend analyses without earlier analyses automatically being fully revised.

8. External sources and third-party information

WoonView may display information from public sources or third parties, such as neighbourhood information, property data, sustainability information, maps, public registers or other data sources.

WoonView aims for current and reliable information, but cannot guarantee that external data is complete, accurate or up to date.

WoonView is not responsible for the content, availability or operation of third-party websites, data sources or services.

9. Subscriptions, prices and payment

A paid subscription or a one-off payment may apply to certain features. Current prices, term, features and any restrictions are stated on the website or in the app.

Payment is made via the payment methods offered. A subscription gives access to the features belonging to the chosen package.

Unless stated otherwise, a subscription is automatically renewed for the same period. The user can cancel the subscription following the procedure indicated on the platform.

Price changes are announced in advance. Where a price change applies to a running subscription, the user is given the opportunity to cancel the subscription before the change takes effect, unless the change is legally permitted without a right of cancellation.

10. Right of withdrawal for consumers

If the user is a consumer and takes out a paid service or subscription online, a statutory cooling-off period of 14 days may in principle apply.

If the user wants immediate access to digital services or analyses during the cooling-off period, WoonView may ask for express consent to start delivery immediately. If the service has been fully delivered within the cooling-off period and the user has acknowledged that the right of withdrawal thereby lapses, the right of withdrawal may lapse for that service.

For subscriptions or services that have not yet been fully delivered, a proportionate fee may be payable on withdrawal for the part of the service already delivered, to the extent permitted by law.

Precise information about withdrawal, any exceptions and how to withdraw is provided during the ordering process or at the time of purchase.

11. Availability and maintenance

WoonView aims to provide a properly working and secure platform, but does not guarantee that the platform is always uninterrupted, error-free or fully available.

WoonView may temporarily take the platform out of service for maintenance, security, updates or improvements.

WoonView is not liable for damage caused by temporary unavailability, delay, loss of access or technical failures, unless there is intent or deliberate recklessness.

12. Intellectual property

All rights to the platform, the software, texts, designs, analysis structures, models, reports, trademarks, logos and other WoonView materials remain the property of WoonView or its licensors.

The user receives only a personal, limited, non-exclusive and non-transferable right to use the platform for their own property search purposes.

It is not permitted to copy, distribute, sell, publish or use parts of WoonView for commercial purposes without prior written consent.

Data and documents uploaded by the user remain the property of the user or the rightful owner. The user grants WoonView the right to process this data in order to provide the service.

13. Privacy and personal data

WoonView processes personal data in accordance with applicable privacy legislation.

The WoonView privacy statement sets out which personal data is processed, for which purposes, how long data is retained and what rights users have.

The user is responsible for handling third-party personal data in uploaded documents with care.

14. Results, decisions and own responsibility

The user is responsible for all decisions taken on the basis of information from WoonView.

This includes, among other things:

  • whether or not to view a property;
  • making or adjusting an offer;
  • entering into a purchase agreement;
  • commissioning further investigation;
  • engaging a buying agent, building surveyor, mortgage adviser, lawyer or notary.

WoonView is a tool for organising and understanding information better. The platform does not take decisions on behalf of the user.

15. Liability

WoonView is only liable for direct damage that is the direct result of an attributable failure by WoonView.

WoonView is not liable for indirect damage, consequential loss, missed savings, missed opportunities, loss of value, disappointment, loss of data or damage caused by decisions the user takes on the basis of information from the platform.

To the extent permitted by law, WoonView’s liability is limited to the amount the user paid to WoonView in the three months preceding the event causing the damage.

This limitation does not apply to damage caused by intent or deliberate recklessness on the part of WoonView.

Nothing in these terms and conditions limits rights a consumer has under mandatory law.

16. Complaints

If the user has a complaint about WoonView, they can get in touch at info@woonview.nl.

WoonView endeavours to handle complaints within a reasonable period. The user is asked to describe the complaint as clearly as possible, including relevant details such as account information, date, and the property or analysis the complaint relates to.

17. Changes to the terms and conditions

WoonView may amend these terms and conditions. The most recent version is published on the website or in the app.

In the case of material changes affecting existing users or subscriptions, WoonView informs users in advance where reasonably possible.

If a user does not wish to accept the amended terms and conditions, the user can stop using WoonView or, in the case of a paid subscription, cancel it following the applicable procedure.

18. Termination

The user can stop using WoonView by deleting their account or cancelling a subscription following the available procedure.

WoonView may terminate an account or restrict access if the user breaches these terms and conditions, misuses the platform, fails to meet payment obligations or endangers the security or operation of the platform.

After termination, access to data, analyses and documents may lapse. The user is responsible for downloading or saving in good time any information they wish to keep.

19. Force majeure

WoonView is not liable for delay or failure resulting from circumstances beyond its reasonable control, such as failures at hosting providers, internet outages, cyber attacks, power failures, government measures, failures at external data sources or third-party services.

20. Governing law and disputes

These terms and conditions and the use of WoonView are governed by Dutch law.

Disputes are preferably resolved by mutual agreement. If that is not possible, disputes may be submitted to the competent court in the Netherlands, unless mandatory law designates a different court.
